FMLA FORMS

The US Department of Labor (DOL) has submitted the Family and Medical Leave Act (FMLA) forms for renewal by the Office of Management and Budget (OMB). The most recent versions originally expired on December 31, 2011.  On Saturday, January 14, 2012, the DOL quietly changed the expiration date on the FMLA forms to January 31, 2012; however, this appears to be the only change at this time. As always, employers should use the most recent versions of the forms; however, be reminded that the DOL forms that expire on January 31 do not address the Genetic Information Nondiscrimination Act (GINA) safe harbor notice employers can provide when seeking medical information from employees and employees' medical providers.

January, 2011 - Changes to Minnesota Landlord-Tenant Law
On May 11, 2010, Governor Pawlenty signed off on a bill that reflects the first substantial changes to landlord tenant law in Minnesota in over a decade. The bill is formally known as HF2668, but is more popularly referred to as the “Tenant’s Bill of Rights.” As one might assume from this title, the law contains a number of pro-tenant amendments to existing Minnesota Statutes. It is important to be aware of these changes and their implications for both current and future leasing relationships. Unless otherwise noted, the following changes went into effect August 1, 2010.

January, 2011 - Department of Labor Defines “Son or Daughter” Under FMLA
The Family and Medical Leave Act (FMLA) allows eligible employees to take up to 12 weeks of leave for three reasons related to a son or daughter. Namely, those three reasons include: 1) to care for a son or daughter with a serious health condition; 2) the birth of a son or daughter and in order to care for them; and 3) the placement of a son or daughter with the employee for adoption or foster care.

October, 2010 - 2011 Changes to Statutory Home Warranties
Several Minnesota statutes governing the relationship between contractors and owners of residential buildings have been revised, with the changes taking effect on January 1, 2011.  One of the most important changes is to warranty provisions in Chapter 327A.  In that chapter, which sets forth the standard homeowner warranties, the legislature has set forth a new dispute resolution process which, in most cases, is required before a lawsuit can be commenced.  Other related changes have also been made to Chapter 327A.
